Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Teamcast, Inc. (“Teamcast”, “we”, “us”) governing your use of our website and AI-led interview and measurement platform (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you confirm you have authority to bind it.

1.What Teamcast provides

Teamcast conducts structured, AI-led behavioral interviews and measures responses against a fixed competency rubric, producing coverage and behavioral evidence traced to the interview transcript. The Service is a measurement system, not a decision-maker: it does not output a hire/no-hire recommendation, and every employment decision is made by a person at the employer.

2.Accounts and eligibility

You must provide accurate registration details, keep your credentials secure, and be responsible for activity under your account. You must be at least 18 and able to form a binding contract. Tell us promptly at hello@teamcast.ai if you suspect unauthorized use.

3.Customer responsibilities and lawful hiring

If you use the Service to evaluate candidates, you are the employer/“deployer” and you are responsible for using it lawfully. In particular, you agree to:

  • Give candidates any legally required notice and obtain any required consent before an interview or assessment.
  • Make the hiring decision yourself, using the evidence as one input among others — never relying solely on automated output.
  • Comply with applicable employment, anti-discrimination, data-protection, and AI laws — including, where applicable, EU AI Act deployer obligations and independent bias-audit and notice requirements (e.g. NYC Local Law 144) for automated employment decision tools.
  • Have a lawful basis for the candidate data you process and honor candidate rights requests.

4.Acceptable use

You agree not to:

  • Use the Service unlawfully, deceptively, or to discriminate against protected groups.
  • Upload content you have no right to, or that is unlawful, infringing, or harmful.
  • Reverse engineer, scrape, overload, probe, or circumvent security or rate limits.
  • Resell or provide the Service to third parties except as expressly permitted.
  • Use outputs as the sole basis for an employment decision, or in any way that misrepresents what the Service measures.

5.Candidate access

Candidates access an interview through a secure link and one-time verification, without creating a full account. Candidates agree to participate honestly and not to disrupt or manipulate the interview. Candidate personal data is handled as described in our Privacy Policy.

6.Fees and billing

Paid plans are billed per the plan you select. Fees are non-refundable except where required by law or expressly stated. We may change pricing on prospective notice; continued use after a change means you accept it. You are responsible for applicable taxes.

7.Intellectual property

Teamcast and its licensors own the Service, including its software, models, rubrics, and brand. You retain ownership of the content you submit; you grant Teamcast a limited license to host and process it to provide the Service. We may use aggregated or de-identified data to operate and improve the Service.

8.Data protection

Our handling of personal data is described in the Privacy Policy. Where Teamcast processes candidate data on your behalf, our Data Processing Agreement applies and forms part of these Terms.

9.AI outputs — no guarantee, no advice

The Service’s outputs are a measurement aid, not legal, hiring, or professional advice and not a decision. While we design for accuracy and traceability, AI-generated transcription and scoring can contain errors. You are responsible for reviewing outputs and exercising independent human judgment. Teamcast does not warrant any particular hiring outcome.

10.Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and do not warrant that the Service will be uninterrupted or error-free.

11.Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.

12.Indemnification

You will defend and indemnify Teamcast against claims arising from your use of the Service in breach of these Terms or applicable law, including claims related to your hiring decisions or your handling of candidate data.

13.Term and termination

These Terms apply while you use the Service. Either party may terminate as set out in the applicable order or plan, or if the other materially breaches and does not cure it. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

14.Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in Santa Clara County, California have exclusive jurisdiction, unless a mandatory consumer law provides otherwise.

15.Changes to these Terms

We may update these Terms from time to time. We will post the revised version here with a new “Last updated” date and, for material changes, provide additional notice. Continued use after an update means you accept the revised Terms.
